Terms and Conditions – Pedrada Tattoo Supplies

1. Scope and Purpose

1.1. These General Terms and Conditions of Sale (“Terms”) regulate the use of the website [www.pedradatattoosupplies.com] (hereinafter “Site”) and the process of buying and selling products sold by [Teodomiro Pedrada Unipessoal Lda], NIF 510025781, with registered office at Largo Vasco da Gama 1, 2825-414 Costa da Caparica, Portugal, hereinafter referred to as “Pedrada Tattoo Supplies”.

1.2. The Site is intended for the sale of tattoo materials and related products.

1.3. These Terms apply to two categories of customers:
the) “Consumer” (B2C): Any individual who acts for purposes that do not fall within the scope of their commercial, industrial, artisanal or professional activity, under the terms of Decree-Leis No. 24/2014, of 14 February.
b) “Professional” (B2B): Any individual or legal entity acting within the scope of their commercial, industrial, artisanal or professional activity, including registered tattoo artists and studios.

1.4. Pedrada Tattoo Supplies reserves the right to request supporting documentation (e.g., declaration of commencement of activity, permanent certificate) to validate the Professional status.

1.5. Placing any order through the Website implies the prior and unreserved acceptance of these Terms by the Customer.

2. Customer Registration and Use of the Website

2.1. To place orders, the Customer must register on the Website, creating a user account.

2.2. The Customer is solely responsible for the veracity, accuracy and updating of the data provided in their registration.

2.3. The Customer undertakes to maintain the confidentiality of his/her access data (username and password) and not to share them with third parties.

2.4. Pedrada Tattoo Supplies is not responsible for any delays, delivery failures or losses resulting from incorrect or incomplete data provided by the Customer.

3. Products and Prices

3.1. Pedrada Tattoo Supplies sells products (such as pigments, needles, machines, etc.) that may be intended exclusively for professional use. It is the Customer's responsibility to verify that they have the necessary qualifications to use the purchased product.

3.2. Pedrada Tattoo Supplies declines any responsibility for the improper, unprofessional or negligent use of the products sold.

3.3. Retail prices are indicated in Euros (€) and include VAT at the legal rate in force, unless otherwise indicated (e.g. prices for Professionals shown without VAT).

3.4. The shipping cost (postage) is calculated at the end of the ordering process, based on the weight, destination and shipping method selected, and is added to the total order value.

3.5. Pedrada Tattoo Supplies reserves the right to change prices, products and specifications at any time without notice.

4. Ordering and Payment Process

4.1. The Customer places their order by selecting products on the Website and completing the “checkout” process.

4.2. The order will only be processed after confirmation of full payment.

4.3. The available payment methods are those presented on the Website (e.g., Multibanco, MB Way, Credit Card, PayPal).

4.4. Pedrada Tattoo Supplies reserves the right of ownership over the products supplied until full payment has been received.

5. Shipping and Delivery

5.1. Orders are shipped to the address indicated by the Customer during the registration or “checkout” process.

5.2. The estimated delivery time will be indicated during the ordering process. These deadlines are merely indicative and may change for reasons beyond Pedrada Tattoo Supplies' control (e.g., carrier delays, holiday seasons).

5.3. Upon delivery, the Customer (or their representative) must check the condition of the packaging. If it shows visible damage, the Customer must refuse delivery or record the incident on the carrier's delivery note and contact Pedrada Tattoo Supplies within 24 hours.

6. Right of Free Resolution (Applicable only to Consumers – B2C)

6.1. Under the terms of Decree-Leiw No. 24/2014, of February 14, the Customer qualified as a Consumer has a period of 14 (fourteen) calendar days, counting from the day on which he acquires physical possession of the goods, to exercise his right to freely terminate the contract, without needing to indicate the reason.

6.2. To exercise this right, the Consumer must notify Pedrada Tattoo Supplies of their decision to cancel through an unequivocal statement (e.g., letter sent by post, email to -). he***@*******************es.com) or by filling out our admin form on the page https://pedradatattoosupplies.com/minha-conta-cliente/formulario-de-adm/.

6.3. In the event of termination, the Consumer must return the goods to Pedrada Tattoo Supplies within 14 days from the date on which the termination was communicated. The costs of returning the goods shall be borne by the Consumer.

6.4. Pedrada Tattoo Supplies will reimburse the Consumer for all payments received, including delivery costs (with the exception of additional costs resulting from the choice of a shipping method other than the least expensive standard shipping method), within 14 days from the date on which it was informed of the withdrawal decision, and may withhold the reimbursement until it has received the returned goods or proof of their dispatch.

6.5. Exceptions to the Right of Withdrawal: The right to free resolution does not apply to:
a) Sealed goods that cannot be returned for health protection or hygiene reasons when opened after delivery (e.g. pigments, needles, gloves, sterilized material).
b) Goods which, by their nature, cannot be returned or are likely to deteriorate rapidly.

7. Returns (Applicable to Professionals only – B2B)

7.1. For Professional Customers, returns will only be accepted in the event of a product defect or shipping error attributable to Pedrada Tattoo Supplies.

7.2. Any complaint regarding a defect or error must be communicated in writing (email to [email address]). he***@*******************es.com) or by filling out our admin form on the page https://pedradatattoosupplies.com/minha-conta-cliente/formulario-de-adm/ within a maximum period of 15 (fifteen) days after receipt of the order.

7.3. Returns of material that has been opened, used or whose original packaging is damaged will not be accepted, unless it is a non-visible manufacturing defect.

8. Warranties

8.1. Consumer Warranty (B2C) 
8.1.1. Under Decree-Leis No. 84/2021, products sold to Consumers enjoy a 3 (three)-year guarantee of conformity, starting from the date of delivery of the goods.
8.1.2. In the event of a lack of conformity (defect), the Consumer has the right to repair, replacement, price reduction or termination of the contract, as applicable.
8.1.3. The warranty does not cover damage resulting from misuse, negligence, accidents, poor maintenance or normal wear and tear of the product.
8.1.4. To activate the warranty, it is essential to present the purchase invoice.

8.2. Warranty for Professionals (B2B) 
8.2.1. In transactions with Professional Clients, the warranty against manufacturing defects is 6 (six) months, counting from the invoice date, in accordance with Article 921 of the Civil Code.
8.2.2. The warranty specifically excludes physical damage, misuse, negligence, drops, damage due to electrical disturbances, technical intervention not authorized by Pedrada Tattoo Supplies or use of unsuitable consumables.
8.2.3. To activate the warranty, it is essential to present the purchase invoice.

9. Personal Data Protection (GDPR)

9.1. Pedrada Tattoo Supplies, as data controller, undertakes to comply with current personal data protection legislation, namely Regulation (EU) 2016/679 (General Data Protection Regulation).

9.2. The personal data collected (name, address, email, tax number, telephone number) are intended exclusively for order processing, invoicing, communication with the Customer and, if the Customer authorizes it, for marketing purposes.

9.3. The Client has the right to access, rectify, erase (right to be forgotten), limit processing, object to processing and request the portability of their personal data by contacting Pedrada Tattoo Supplies via email. he***@*******************es.com.

10. Alternative Dispute Resolution (Applicable only to Consumers – B2C)

11.1. In the event of a consumer dispute, the Consumer may resort to an Alternative Consumer Dispute Resolution (ADR) Entity.

11.2. The list of RAL entities can be consulted on the Consumer Portal at [www.consumidor.gov.pt].

11.3. The Consumer may also use the European online dispute resolution platform, available at [http://ec.europa.eu/consumers/odr].

11. Applicable Law and Jurisdiction

12.1. All commercial and contractual relationships established through the Website are governed by Portuguese law.

12.2. For the resolution of any emerging disputes:
a) If the Customer is a Consumer (B2C), the court of his/her domicile or the District Court of Almada will have jurisdiction.
b) If the Client is a Professional (B2B), the District Court of Almada will have jurisdiction, expressly waiving any other.
